Terms of Service

These terms govern your use of BumpHQ. By creating an account or using the service, you agree to them. Please read — they are written in plain English.

1. About BumpHQ

BumpHQ ("we", "us", "the service") is a Discord server growth automation platform at bumphq.co. We automate Disboard bumping, manage portal servers, and provide analytics — all on behalf of Discord server owners ("you", "customers").

By registering an account, you confirm that you are at least 13 years old (or 16 in EU/UK), that you have read and agreed to these Terms, and that you have the authority to bind any organization on whose behalf you use BumpHQ.

2. Acceptable use

2.1 You may use BumpHQ to

• Automate legitimate Disboard bumps for Discord servers you own or administer.
• Manage portal servers for community growth purposes.
• Use ghost-ping and engagement features for your own servers.
• Access analytics and dashboard features for your connected servers.

2.2 You may NOT use BumpHQ to

• Illegal content: Promote, host, or distribute content that is illegal in your jurisdiction or the EU, including but not limited to child sexual abuse material (CSAM), content that sexualizes minors in any way, materials facilitating violence or terrorism.
• NSFW servers accessible to minors: Use BumpHQ to grow or manage any server that contains adult content (NSFW) without proper age-gating controls in place, or any server whose primary audience is users under 18.
• Warez and piracy: Use BumpHQ to grow servers that distribute or promote pirated software, games, media, or other copyrighted material without authorization.
• Spam: Use BumpHQ to conduct mass unsolicited DMs, spam campaigns, coordinated inauthentic behavior, or to manipulate Discord's systems in ways that violate Discord's Terms of Service.
• Scams and fraud: Operate servers designed to defraud users, conduct phishing, crypto scams, pump-and-dump schemes, or any fraudulent activity.
• Hate and harassment: Grow or manage servers that promote hatred, discrimination, or targeted harassment based on protected characteristics.
• Ban evasion: Use BumpHQ to circumvent bans, suspensions, or restrictions imposed by Discord or Disboard.
• Credential abuse: Share, sell, or misuse bot tokens through BumpHQ's systems. Each bot token must belong to a bot account you legitimately control.

3. Discord and Disboard compliance

You are responsible for ensuring your use of BumpHQ complies with:

• Discord's Terms of Service and Community Guidelines
• Disboard's Terms of Service
• All applicable laws in your jurisdiction

BumpHQ automates actions on your behalf. You remain responsible for the behavior of your connected bot accounts and servers. We are not liable for actions Discord or Disboard take against your accounts as a result of your use of this service.

4. Account responsibilities

• You are responsible for maintaining the security of your BumpHQ password and any bot tokens you store with us.
• You must notify us immediately at security@bumphq.co if you suspect unauthorized access to your account.
• You may not share, sell, or transfer your BumpHQ account to another person.
• One account per person. Creating multiple accounts to circumvent restrictions is prohibited.

5. Payment terms

5.1 Subscriptions

BumpHQ offers subscription plans billed on a recurring basis (monthly or annually). By subscribing, you authorize us to charge your payment method on each billing date. All prices are in USD unless otherwise stated.

5.2 Free trial

Where offered, a free trial converts to a paid subscription at the end of the trial period. You may cancel before the conversion date to avoid being charged.

5.3 Cancellation

You may cancel your subscription at any time via your dashboard settings. Cancellation takes effect at the end of your current billing period — you retain access to paid features until then. We do not offer partial-month refunds for cancellations.

5.4 Refunds

Refunds are issued at our discretion. We will consider refund requests made within 7 days of a charge if the service was materially unavailable during that period. To request a refund, contact billing@bumphq.co.

5.5 Price changes

We may change subscription prices with 30 days' notice. Existing subscribers will be notified by email and may cancel before the new price takes effect.

5.6 Failed payments

If a payment fails, we will retry up to 3 times over 7 days. If payment cannot be collected, your subscription will be suspended and then canceled. Reactivation requires a new subscription.

6. Service availability

We reserve the right to perform scheduled maintenance, which we will announce in advance where possible. Emergency maintenance may occur without notice.

During the beta period, the service may experience higher-than-usual downtime. Beta status is communicated on our status page and in our onboarding materials.

7. Intellectual property

BumpHQ and its content (code, design, documentation, branding) are owned by BumpHQ and protected by intellectual property law. You may not copy, modify, distribute, or create derivative works from our platform without written permission.

You retain all rights to your Discord server content. By using BumpHQ, you grant us a limited, non-exclusive license to process your server data (IDs, bump logs, configurations) solely to operate the service.

8. Account termination

8.1 Termination by you

You may delete your account at any time via dashboard settings. Deletion initiates a 30-day soft-delete grace period (during which you may request reactivation), followed by permanent deletion of all associated data.

8.2 Termination by us

We may suspend or terminate your account with or without notice if:

• You violate any provision of these Terms, especially Section 2.2 (prohibited uses).
• Your use of the service causes harm to other users, BumpHQ's infrastructure, or third-party services.
• We are required to do so by law or court order.
• Your account has been inactive for 12+ consecutive months and you have no active subscription.

Upon termination for cause, we may immediately disable access without refund. We will provide the reason for termination unless disclosure is prohibited by law.

9. Limitation of liability

To the maximum extent permitted by law:

• BumpHQ is not liable for any indirect, incidental, consequential, or punitive damages, including loss of revenue, server growth, or data.
• Our total liability to you for any claim arising from use of the service is limited to the amount you paid us in the 3 months preceding the claim.
• We are not liable for actions Discord, Disboard, or any third party takes against your accounts.

Some jurisdictions do not allow limitation of certain warranties or liabilities, so some of the above may not apply to you.

10. Disclaimer of warranties

BumpHQ is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or produce specific results (e.g., server member growth).

11. Indemnification

You agree to indemnify, defend, and hold harmless BumpHQ and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your violation of these Terms, your violation of any law, or your infringement of any third party's rights.

12. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which BumpHQ is operated, without regard to conflict-of-law provisions. Disputes will first be addressed through good-faith negotiation. If unresolved after 30 days, disputes may be submitted to binding arbitration or a court of competent jurisdiction.

13. Changes to these Terms

We may update these Terms at any time. For material changes, we will provide at least 14 days' notice via email before the new Terms take effect. Your continued use of BumpHQ after the effective date constitutes acceptance. If you disagree with updated Terms, you may terminate your account before the effective date.

14. Miscellaneous

• Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and BumpHQ.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• No waiver: Our failure to enforce any provision does not waive our right to do so in the future.
• Assignment: You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
